"ClaimSpeak" refers to the claim intelligence platform operated at claimspeak.app. "Partner" refers to the property management company entering into this agreement. "Referral Link" refers to the unique URL assigned to the Partner, used to direct property owners to the ClaimSpeak platform. "Session" refers to a single engagement period initiated by a property owner through the Referral Link. "Query" refers to an individual question or input submitted by a property owner within a Session.

ClaimSpeak is an informational platform that provides property owners with clarity on their insurance claims. ClaimSpeak is not representation, advocacy, legal advice, or a substitute for licensed professional counsel. ClaimSpeak does not act on behalf of any party, does not contact carriers, and does not negotiate or influence claim outcomes.

The Partner shares the Referral Link with property owners as an educational resource. The Partner does not represent ClaimSpeak as a service of the company, and ClaimSpeak does not represent itself as an extension of the Partner's business.

ClaimSpeak agrees to: maintain the platform and keep the Partner's Referral Link active for the duration of this agreement, provide usage reports tied to the Partner's Referral Link, and ensure all property-owner-facing output remains informational and non-representational.

The Partner agrees to: share the Referral Link only as an educational resource, not misrepresent ClaimSpeak as representation, advocacy, or professional advice, and not position ClaimSpeak as a product or service of the company.

The Referral Link may be shared with property owners when a claim arises, when coverage questions surface, or at any point where the owner needs clarity on the insurance side of a property situation. When sharing, the Partner should present ClaimSpeak as an independent claim clarity tool available to the property owner — not as insurance advice, not as a claims service, and not as a product offered or endorsed by the company.

When a property owner opens the Referral Link, ClaimSpeak grants a full-access Session lasting 48 hours from the moment of activation. During this window the property owner has unlimited use of the platform's tools.

After a Session expires, a cooldown period of 5 days applies before the same property owner device can begin a new Session through the Referral Link. Once the cooldown passes, the property owner may open the Referral Link again for a fresh 48-hour Session.

A property owner who wants continuous access without waiting out the cooldown may unlock the platform directly at any time through ClaimSpeak's standard access option. Partners who maintain a paid widget subscription provide their property owners with an extended 8-day access window per visit and no cooldown; the 48-hour Session and 5-day cooldown described here apply to the free Referral Link only.

ClaimSpeak also offers pre-loss documentation and move-in/move-out inspection services across portfolios. Pre-loss documentation provides comprehensive property condition records before any loss occurs, strengthening the owner's position when a claim is filed. Move-in/move-out inspections provide dated condition records at lease start and lease end, protecting against tenant damage disputes and security deposit challenges.

These services are separate from the Referral Link and can be incorporated into the Partner's management agreement as additional offerings. Scope and scheduling are coordinated directly between ClaimSpeak and the Partner.

ClaimSpeak tracks the following from the Partner's Referral Link: link clicks, Sessions created, Queries submitted, query volume, and engagement depth across the portfolio. Usage can be broken down by property or owner where a property identifier is provided. No personally identifiable property owner information is shared with the Partner. Usage reports contain aggregate data only.

All ClaimSpeak materials, branding, platform output, and technology remain the exclusive property of ClaimSpeak. The Partner may not use ClaimSpeak's name, logo, or materials for any purpose other than sharing the Referral Link as described in this agreement. The Partner may not create derivative marketing materials, tools, or representations that incorporate ClaimSpeak branding or content without prior written consent from ClaimSpeak.

ClaimSpeak is informational only. Neither party is liable for the actions, decisions, or outcomes of the other. ClaimSpeak does not guarantee claim outcomes, and the Partner does not guarantee property owner engagement with the platform.

The Partner agrees to indemnify and hold ClaimSpeak harmless from any claims, damages, or liabilities arising from the Partner's misrepresentation of ClaimSpeak as representation, advocacy, legal advice, or any service beyond its stated informational scope. ClaimSpeak agrees to indemnify and hold the Partner harmless from any claims, damages, or liabilities arising directly from defects in the ClaimSpeak platform itself.
